These terms and conditions may be modified by the provider at any time, the user being informed of the existence of any new version of these that contain changes that are substantial

Access, browsing and use of the Website, confers the condition of user, and therefore, from the moment browsing the Website begins, all the Conditions established herein are accepted, as well as their subsequent modifications, without prejudice to the application of the corresponding legal regulations of obligatory compliance as the case may be.

The User assumes responsibility for the correct use of the Website. This responsibility extends to:

To make use of this Website only to make enquiries and legally valid purchases or acquisitions.
Not to make any false or fraudulent purchases.
To provide truthful and lawful contact details, e.g. email address, postal address and/or other details.
The User declares that he/she is over 18 years of age and has the legal capacity to enter into contracts through this Website.
The Website is primarily intended for Users residing in Spain, and no representation is made that the Website complies with the laws of other countries, either wholly or in part.

Applicability of the general conditions:

These conditions apply to all quotations, offers, activities, agreements and deliveries of products by or on behalf of Musita's. Deviation from these conditions is only possible if the parties have so explicitly agreed in writing.

Purpose:

The present conditions shall regulate the use of the website www.musitaslanzarote.myshopify.com which it makes available to its users and customers. The products that the provider sells through its website are mainly:

Retail sale of footwear and accessories.

These General Conditions have been drawn up in accordance with the provisions of Law 34/2002, on information society services and electronic commerce, Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, all of which are mandatory legal provisions.

The provider may modify them without prior notice, and therefore recommends that you consult them periodically, especially when you are preparing to make effective use of its online shop located on the website www.musitaslanzarote.myshopify.com. However, the provider undertakes to always keep them updated, to publish the latest version.

Conditions of access and purchase:

Access to the Musita's Portal is free and attributes the condition of User to whoever does so, regardless of the subsequent use of the services offered.

Purchases may be made without the need for prior registration, and in any case the form must be completed in order to identify the purchaser and the delivery address.

The purchase of the products on www.musitaslanzarote.myshopify.com may only be made by users over eighteen (18) years of age, who must follow the steps and instructions that will accompany the entire purchase process, consisting of, but not limited to:

(i) Completion of the registration form or the identification form for previously registered users;

(ii) On-screen display of the order summary, delivery conditions and shipping costs, if applicable;

(iii) Acceptance of the purchase conditions, which implies the reading, understanding and irrevocable acceptance of each and every one of the present General Conditions, as well as, if applicable, of the existing Particular Conditions; and

(iv) immediate receipt of a summary e-mail in the account used for registration or - failing that - as soon as possible and always within twenty-four hours.

The purchase of products on www.musitaslanzarote.myshopify.com for subsequent distribution or resale, whether in public establishments or at home, is not permitted. The provider shall regulate and authorise the necessary permits if at any time it consents to do so, and shall notify the authorised agent of such authorisation.

Orders:

No valid order may be placed without expressly accepting, through the boxes provided for this purpose, the terms and conditions and privacy policy.

All orders shall be deemed to be offers to purchase subject to these terms and conditions. The provider reserves the right to accept them if the requirements set out in these terms and conditions are not met.

Once an order has been placed, the system automatically generates a confirmation of receipt of the order. However, this confirmation does not imply automatic acceptance of the order, since the provider reserves the right to collect additional information related to the identity and address to ensure both a correct shipment of the order, and to ensure the absence of fraud related to transactions.

Orders can be placed 365 days a year, at any time, except at times when the service is suspended for maintenance or other commercial circumstances and / or force majeure.

Any order is subject to product availability. In the event that it is not possible to deliver an order due to supply problems or insufficient stock, the user will have the option to wait until the product is available or cancel the order.



Delivery. Please read the delivery policy of the Website.
Delivery shall be deemed to have taken place when the user or a third party indicated by the user acquires material possession of the products.

The delivery time for the order will vary according to the shipping method selected and will be indicated on the website once the order confirmation is obtained. In the event that the delivery date cannot be met, we will inform the user of this circumstance and the user will be offered the option to go ahead with the purchase by setting a new delivery date or the possibility of cancelling the order and obtaining a full refund of the price paid.

If the recipient is absent at the time of delivery, a notice will be left so that he/she can pick up the shipment at the place and within the time indicated. Musitás is not responsible for the loss of the product due to the user not providing the address correctly.

Price and payment:
It is understood that the price of each product is the one that will appear on the website at the time of placing each order. The user must pay the marked price, including the applicable taxes, together with the shipping costs, which will be added to the final price to be paid.

Prices may be modified by the Provider at any time and without prior notice without affecting orders already confirmed. However, even if confirmed, the Provider shall not be obliged to fulfil orders when the price is incorrect, especially when the error is obvious and easily recognisable.

The accepted means of payment are:

Payment by credit or debit card. We reserve the right NOT to accept certain payments with certain credit cards.

Payment by PayPal.

The provider reserves the right to change the payment methods, and may create new ones or eliminate any of the existing ones, without the user/customer of www.musitaslanzarote.myshopify.com being able to make claims for this reason. However, if the change in the method of payment affects an order already placed, www.musitaslanzarote.myshopify.com will contact the customer to inform them of the change, offering them the option to cancel the order if they deem it appropriate.

Payment by credit/debit card: The charge is made online, that is to say, in real time, through the payment gateway of the corresponding financial entity and once it has been verified that the data communicated are correct. In order to provide maximum security to the payment system, www.musitaslanzarote.myshopify.com uses secure payment systems from leading financial institutions in e-commerce. In this sense, confidential data is transmitted directly and in encrypted form (SSL) to the corresponding financial entity. Credit card details are not recorded in any of our databases. They are only used in the virtual POS (Point of Sale Terminal) of Musita's financial institution through its Secure Payment Gateway. Credit cards will be subject to checks and authorisations by the issuing bank, but if the bank does not authorise payment, the provider is not responsible for any delay or non-delivery and cannot enter into any contract with the customer. The provider reserves the right to verify the personal data supplied by the customer and to take any measures it deems appropriate (including cancellation of the order) to ensure that the goods purchased are delivered in accordance with the data contained in the order.

PayPal payments are made directly on the PayPal website, following the conditions of use established by PayPal. If the order is not paid for within one hour, the Provider shall consider the order to be cancelled.

9. Right of withdrawal. See return policy on the website.

The User has the right to withdraw from the contract concluded through www.musitaslanzarote.myshopify.com within a period of 15 calendar days without the need for justification.

The withdrawal period will expire 15 calendar days after the day on which the User or a third party indicated by the User, other than the carrier, has acquired material possession of the goods.

To exercise the right of withdrawal, the User must notify Musita's of his decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail). The User may use the model withdrawal form included at the end of these conditions, although its use is not obligatory.
To meet the withdrawal deadline, it is sufficient for the communication concerning the User's exercise of this right to be sent before the corresponding deadline expires.

In the event of withdrawal, the Provider shall refund all payments received from the User, without undue delay and, in any case, no later than 15 calendar days from the date on which the User informs Musita's of his decision to withdraw from the contract. The Provider shall proceed to make such reimbursement using the same means of payment used. The Provider may withhold reimbursement until the goods have been received, and it has been verified that the item has arrived in perfect condition and in the same original packaging.

The User must return or deliver the goods directly to Musita's without undue delay and, in any case, no later than 15 calendar days from the date of receipt of the order. Said return shall be made to the address: Avda Las Palmeras nº 30, Costa Teguise, 35509, Lanzarote. The deadline will be considered to have been met if the User returns the goods before this period has expired. The User must bear the direct cost of returning the goods.

The User shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

It is hereby specified that any products not sealed after delivery or which may be subject to return

The right of withdrawal shall not apply to contracts relating to:

The supply of goods made to the specifications of the consumer and user or clearly personalised.
When the deadline for returning the goods has passed.
If the product, once received by the provider and checked, is not in the same condition as when it was sent, has not been damaged and there is no evidence that it has been used.

10. Warranty:

In accordance with the General Law for the Defence of Consumers and Users and other complementary laws, offers on all its products a guarantee of two (2) years from delivery and we will proceed, as appropriate, to repair, replace, reduce the price or refund the amount of the product. If you need to make a warranty claim, please contact us through the contact means provided above.

This warranty does not cover possible breakage or wear and tear caused by use. The consumer and user must inform the seller of the lack of conformity within two months of becoming aware of it.

11. Customer service:

Musitás has a customer service department so that the User can manage their complaints, doubts, or can request guarantees and execute the right of withdrawal.

The User can address their complaints, claims or requests for information to the Customer Service Department, using any of the following methods:

- By filling in the form available in the "Contact us" section of the website".

All doubts and especially complaints and suggestions will be dealt with as quickly as possible, without exceeding in any case the deadlines established by current legislation.

Likewise, you will have proof of them by means of a written receipt, on paper or any other durable medium.

Language of the contract:
These general conditions of sale are written in Spanish. In the event that they are translated into one or more foreign languages, the Spanish text shall prevail in the event of litigation.



Applicable law:
These General Conditions are governed by Spanish law. The parties submit, at their choice, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of the user's domicile.
